Deciding Whether to Appeal a BVA Denial and How to File the Appeal

This session will address the fundamental questions of why to file an appeal, whether to file an appeal in a specific case, and how to file an appeal. The presenter covers alternatives to appealing in both the legacy and AMA systems, the court’s jurisdiction, and the requirement for issue exhaustion. He explains how to analyze Board of Veterans’ Appeal decisions to spot appealable issues. He will review the mechanics of filing, to include exceptions to the 120-day filing deadline.

EAJA Petitions and Disputes

This presentation will explain what the Equal Access to Justice Act (EAJA) is, the elements that must be proven to qualify for an award, the rules for applying, how offsets work, and how to handle disputes.

Motions Before the CAVC
